4-1. Minutes, February 22, 2011.

Staff recommendation: Approve

4-2. a. Ratification of City of Albany net payroll in the amount of $204,207.69; taxes, benefits & withholdings in the amount of $264,592.36. Total payroll in the amount of $468,800.05.Payroll period: 02/25/11.
b. Ratification of Albany Municipal Services JPA net payroll in the amount of $50,173.85; taxes, benefits & withholdings in the amount of $61,845.48. Total payroll in the amount of $112,019.33. Payroll period: 02/25/11.

Staff recommendation: Ratify.

4-3. a. Resolution No. 2011-11 – A Resolution of the Albany City Council Amending the Albany Bicycle Master Plan (BMP) to Include Buchanan Street as a Class I Bicycle Facility and Modify Relevant Test.
b. Resolution No. 2011-12 – A Resolution of the Albany City Council Submitting an Applicant to the Bicycle Transportation Account Program (BTA) for $600,000 in Grant Funding and Commit to Providing the Required 10% Local Match for the Buchanan Bikeway Project.

5. GOOD OF THE CITY/PUBLIC FORUM/ANNOUNCEMENTS

For persons desiring to address the City Council on an item that is not on the agenda please note that City policy limits each speaker to three (3) minutes. The Brown Act limits the Council’s ability to take and/or discuss items that are not on the agenda; therefore, such items are normally referred to staff for comment or to a future agenda.

8-1. Ordinance No. 2011-1 – An Ordinance of the Albany City Council to Amend the Albany Municipal Code to Allow Council via Resolution to Set Hours of Operation for Parks not Currently Listed in the Municipal Code. First Reading.

8-2C Citygate Excerpt

Staff recommendation: 1) Consider sharing a Fire Chief with the City of Piedmont, on a trial basis, and agendize a City Council action item to authorize entering into a contract with Piedmont for a trial period. 2) Approve Resolution No. 2011-14 – A Resolution of the Albany City Council Authorizing Continuation of a Contract with Marc McGinn to Provide Part-Time Fire Chief Services on a Temporary, hourly basis.

8-3. Resolution No. 2011-10 – A Resolution of the Albany City Council Authorizing the City Manager to Enter into a Contract With Caltrans Upon Receipt of a Community-Based Transportation Planning Grant for the Development of a Study for Complete Streets for Buchanan Street and San Pablo.

Staff recommendation: Approve.

8-4. Resolution calling for a constitutional amendment to rectify the U.S. Supreme Court’s 2010 ruling in Citizens United v. the Federal Election Commission that rolled back limits on corporate spending on election campaigns.

Council Member Atkinson’s recommendation: Refer the resolution to the Social & Economic Justice Commission for analysis on pros and cons, and suggestions for any alternative language, with a report back to Council within six months.

8-5. Council Member Lieber report on the Associated Community Action Program (ACAP).

Council Member Lieber’s recommendation: That Council receive an oral report for review and discussion from its representative to the ACAP Joint Powers Authority on recent managerial and financial developments.
