This meeting will include discussion of Design Review for 1041 Santa Fe, Design Review for 1054 Tevlin, Design Review and Conditional Use Permit for 631 San Carlos, Parking Exception for a restaurant at 747 San Pablo, Conditional Use Permit for Medical Marijuana at 745-747 San Pablo, Design Review for 949 Ordway, and Sustainable Community Strategy/Bay Area Plan “Initial Vision Scenario”.

By approval of the Consent Calendar, the staff recommendations will be adopted unless otherwise modified by the Commission. There will be no separate discussion on these items unless a Commission Member or a member of the audience requests removal of the items from the Consent Calendar.)
a. 1041 Santa Fe. Planning Application 11-023. Design Review.
The applicant is requesting design review approval to add a total of 193 square feet to the home. The addition would be in three places, including the south side of the first level, the southwest corner of the second level, and the northeast corner of the second level.

b. 1054 Tevlin. Planning Application #11-025. Design Review.
The applicant is requesting design review approval to 319 square feet to the existing second level of the house.

5. PUBLIC COMMENT
For persons desiring to address the Commission on an item that is not on the agenda please note that each speaker is limited to three (3) minutes. The Brown Act limits the Commission ability to take and/or discuss items that are not on the agenda; therefore, such items are normally referred to staff for comment or to a future agenda.
6. DISCUSSIONS & POSSIBLE ACTION ON MATTERS RELATED TO THE FOLLOWING ITEMS
a. 631 San Carlos. Planning Application #11-015. Design Review and Conditional Use Permit
The applicant is requesting design review approval for a 735 square foot, two-story addition. A conditional use permit is requested to allow a 3’ 2” side yard setback on the north side, when normally 3’ 9” would be required.

Recommendation: Approval.
b. 747 San Pablo. Planning Application #11-021. Parking Exception.
The applicant is requesting approval to allow a “burger” style restaurant in a 1,678 square foot portion of the building. City standards typically require eight off street parking spaces for this sized restaurant. No off-street parking is available for the proposed use. Thus, a parking exception is required.

c. 745-747 San Pablo. Planning Application #09-060. Conditional Use Permit.
The applicant is requesting approval to allow a medical marijuana dispensary in a portion of the building. The proposal does not appear to comply with City requirements for the location of a dispensary. In addition, the property owner has leased the space to another tenant for a restaurant use (see separate agenda item). The applicant, however, has not withdrawn their application.

Recommendation: Denial.
d. 949 Ordway. Planning Application #11-026. Design Review.
The applicant is requesting design review approval to add a second level to the home, resulting in a 2,487 square foot residence. The height of the residence is proposed to increase to 28 feet.

Recommendation: Commission provide direction to staff and the applicant on refinements to the design.
e. Sustainable Community Strategy/Bay Area Plan “Initial Vision Scenario”
Update on the regional plan for housing and employment development associated with a state mandates for reduction of greenhouse gas emissions. The released plan calls for an increase in the rate of growth of households in Albany and surrounding communities.

7. ANNOUNCEMENTS/COMMUNICATIONS/DISCUSSION
a. City of Albany Planning and Zoning Update “E-Notification”
b. Update on City Council agenda items related to Planning and Zoning activities.
c. Review of status of major projects and scheduling of upcoming agenda items.
8. FUTURE PLANNING AND ZONING COMMISSION MEETING AGENDA ITEMS
(Staff discussion and Commission member announcement of status of previous agenda items and requests for future agenda items. No public comment will be taken on requests for future agenda items).
9. ADJOURNMENT
Note: As a general policy, the Commission will not begin discussion or consideration of an agenda item after 11:00 pm.
