Staff recommendation: Reject the lowest bidder, IMR Contractors Corp (IMR), as non responsive and award a contract to the second low bidder, Cal-Bay Construction (Cal Bay) of San Leandro, California.

6. PRESENTATION/PUBLIC HEARING
6-1. Presentation to Albany Library proclaiming April 11—17, 2010 as National Library Week.
6-2. Proclamation declaring May 1st as Silver Star Service Banner Day in the City of Albany.
6-2. Voices to Vision.
Fern Tiger Associates will present the results of Voices to Vision – a comprehensive process to determine the community’s vision for the Albany waterfront. Fern Tiger will present key findings and recommended guidelines that reflect the collective thoughts and concerns of the more than 1,200 Albany residents who participated in the visioning process. The written Voices to Vision report will be available online April 6, 2010, at www.voicestovision.com.
Staff recommendation: 1) Receive report presentation. 2) Take initial public questions and comments and schedule public question and comment time for the City Council meeting of April 19, 2010 to enable residents to have two (2) weeks to gather their thoughts, reflect on the recommendations and read the full report. 3) Schedule an agenda item for the meeting of April 19, 2010 for City Council acceptance of the report and any follow up actions and/or activities.
7. UNFINISHED BUSINESS
7-1. Reconsideration of adoption of Resolution No. 2010-9 adopting the City of Albany Climate Plan.

Staff recommendation: 1) Reconsider adoption of Resolution No. 2010-9 Adopting the Albany Climate Action Plan. This matter is being brought to Council due to the possible conflict of interest of a Council Member concerning amendment language regarding height limits on San Pablo Avenue. 2) Rescind Resolution No. 2010-9 and adopt Resolution No. 2010-15 – A Resolution of the Albany City Council Adopting the City of Albany Climate Action Plan; and reconsider the following language previously added as an amendment: “Delete reference to wind turbine and add language to maintain current height requirements on San Pablo Avenue.”
8. NEW BUSINESS
8-1. Proposition 15 – The California Fair Elections Act. This Proposition is on the June, 2010 ballot to create a pilot project providing voluntary public financing for candidates running for Secretary of State in 2014 and 2018. Proposition 15 is patterned after the Fair Elections system now working in Arizona, Maine and Connecticut, but is adapted for California.

Mayor Wile recommendation: Endorse Proposition 15, which is also supported by AARP and the League of Women Voters.
