a. 752 Pierce Street. Planning Application 09-073. Design Review
The subject property is a 5,100 square foot, odd-shaped, corner lot. The applicant is recently completed a remodel and expansion of the home. Following completion of the project, the applicant has submitted an application to allow construction of a second story balcony on the west side of the residence. The application also involves the replacement of an existing window with a sliding glass door onto the proposed balcony.

b. 636 San Pablo Avenue. Planning Application 09-067. Conditional Use Permit
The subject property is an existing 4,876 square foot commercial building on San Pablo Avenue. The applicant is requesting a conditional use permit to allow a DNA sequencing facility. Samples would be collected off-site by staff or received by mail. The facility would operate both during regular business hours and in the evening to midnight. A maximum of five employees would be on-site at any one time.

c. 835 San Pablo Avenue. Planning Application 09-059. Conditional Use Permit
The subject property is an existing 2,300 square foot commercial building on San Pablo Avenue. The applicant is requesting a conditional use permit to allow massage services to be provided seven days a week between 10:00 am and 10:00 pm. A maximum of eight employees would be on-site at any one time.

The Brown Act limits the Commission ability to take and/or discuss items that are not on the agenda; therefore, such items are normally referred to staff for comment or to a future agenda.

6. DISCUSSIONS & POSSIBLE ACTION ON MATTERS RELATED TO THE FOLLOWING ITEMS

a. 947 Jackson Street - Planning Application 09-076. Design Review and Parking Exception
The subject property is a 2,500 square foot lot with a partially constructed 1,553 square foot two-story residence. The applicant received Planning and Zoning Commission approval for the project in 2004. Due to the lack of progress in the construction of the project, project approvals have lapsed. Recently the City has initiated code enforcement action regarding hazardous conditions at the property and seeking either completion of the project or demolition of the partially constructed project. In order to comply with code enforcement procedures, the City must offer the applicant an opportunity to complete the project. The proposed action is to reinstate prior design review and parking exception approvals.

b. 822 Pomona - Planning Application 09-069. Design Review & Conditional Use Permit
The subject property is a 3,575 square foot lot with a 1,567 square foot split-level, single-family home. The applicant is requesting approval to allow a 103 square foot addition on the upper floor of the home. The proposed addition includes a 2’-11” side-yard setback, where 3’-6” is normally required. In addition, the applicant is proposing a 10”-thick buttress wall on the northern side of the home that will extend fully into the side-yard setback.

Recommendation: Provide direction to the applicant and staff. This is a study session for discussion only; no action is taken at this time.

c. 1700 Sonoma - Planning Application 09-061. Design Review
The subject property is a 5,500 square foot sloping lot with a 1,272 square foot single-story home. The applicant would like to construct a 973 square foot second-story addition, and convert 722 square feet of crawl space into habitable space. The maximum height of the home will increase from 22 feet to 29 feet in height. There is a detached garage that is proposed to be removed, which will provide space for the two off-street parking spaces.

d. Review of State Comments on Proposed General Plan Housing Element
Review of feedback provided by the California Department of Housing and Community Development and proposed revisions to Draft Housing Element.

Recommendation: Take public testimony, provide direction to staff on appropriate revisions, and recommend initiation of California Environmental Quality Act review.

e. 2010 Planning and Building Division Work Program
Review of anticipated tasks and activities of the Planning and Building Division for calendar year 2010.

f. Election of Planning and Zoning Commission Officers
Albany Municipal Code Chapter II (Administration), Section 2-18, states that the Commission shall select a chair and vice-chair at least thirty and not more than 45 days after the annual City Council reorganization.
Recommendation: Planning and Zoning Commission elect a chair and vice chair


7. ANNOUNCEMENTS/COMMUNICATIONS/DISCUSSION

a. City of Albany Draft Climate Action Plan
Brief report on January 4, 2010 City Council study session and staff update on next steps. (No staff report attached.)

b. California Massage Therapy Council Regulations
Brief report on implications of new state regulations.


8. FUTURE PLANNING AND ZONING COMMISSION MEETING AGENDA ITEMS

a. Next regularly scheduled Planning and Zoning Commission hearing scheduled for January 26, 2010.

(Staff discussion and Commission member announcement of status of previous agenda items and requests for future agenda items. No public comment will be taken on requests for future agenda items).
