5. PUBLIC COMMENT
For persons desiring to address the Commission on an item that is not on the agenda please note that each speaker is limited to three (3) minutes. The Brown Act limits the Commission ability to take and/or discuss items that are not on the agenda; therefore, such items are normally referred to staff for comment or to a future agenda.

6. DISCUSSIONS & POSSIBLE ACTION ON MATTERS RELATED TO THE FOLLOWING ITEMS

a. 742 Masonic. Planning Application 09-044. Conditional Use Permit. Parking Exception. Request for a conditional use permit and parking exception to allow a large family day care to operate at the site.

b. 949-953 San Pablo. Planning Application 09-022. Design Review. Parking Exception.
Conditional Use Permit.
On July 14, 2009, the applicant received Design Review approval for the improvements, a Parking Exception to allow reduced parking and a Conditional Use Permit to allow parking on the rear parcel, which fronts onto Kains Avenue. The upcoming hearing is intended to modify the findings and conditions of approval to reflect dialogue that has occurred between the applicant and neighborhood representatives and to allow full alcoholic beverage service.

c. 1352 Marin. Planning Application 09-038. Design Review. The applicant is requesting Design Review approval to allow a 239 sq.ft. addition to the first-floor and add a new 503 sq. ft. second-story addition, both at the rear of the home.

d. 916 Santa Fe. Planning Application 09-046. Design Review. The applicant is requesting Design Review approval to allow a 782 sq. ft. two story addition to the rear of the home.

e. Recommendation to the City Council on Proposed to Initiate Amendments to the Planning and Zoning Code to Correct and Clarify Development Regulations.
Staff recommendation: That the Commission review City Council comments on the draft ordinance containing proposed amendments to the Planning and Zoning Code, and consider revisions to the Commission recommendation.

7. ANNOUNCEMENTS/COMMUNICATIONS/DISCUSSION

a. Update on Sustainability Committee meeting and University Village Residents Association meeting

b. City of Albany Comments on Draft Environmental Impact Report for the Pt. Molate Mixed Use Tribal Destination Resort and Casino

c. Update on City Council actions related to Planning and Zoning.

8. FUTURE PLANNING AND ZONING COMMISSION MEETING AGENDA ITEMS

a. Next Planning and Zoning Commission hearing scheduled for Tuesday, October 13, 2009.

(Staff discussion and Commission member announcement of status of previous agenda items and requests for future agenda items. No public comment will be taken on requests for future agenda items).
